Terms and Conditions of Sale

1. General

All contractual relationships between users of this site (hereinafter referred to as ‘the customer’), and the site owner, A & R Motorcare and it’s trading name of In Car Magic (both hereinafter referred to as In Car Magic) are subject to the following terms and conditions. These shall form part of any contract between the customer and In Car Magic. In Car Magic reserve the right to amend these terms and conditions from time to time by updating this text page; and the customer is bound by any such modifications or revisions. Completion of an order request and payment are deemed conclusive evidence that the customer agrees to be bound by these terms. This does not affect the customer’s Statutory Rights as a consumer.

2. The Contract

The contract between In Car Magic and the customer comes into existence when In Car Magic accepts the customer’s order i.e. when payment has been received. In Car Magic is entitled to reverse or withdraw from contracts in the case of obvious typographical or arithmetical inaccuracies appearing in the In Car Magic on-line store. These terms and conditions shall be governed by and construed in accordance with the laws of England and any disputes arising will be decided only by the English courts. In Car Magic makes no promise that materials on the In Car Magic site are appropriate or available for use in locations outside the United Kingdom, and accessing the In Car Magic site from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do this on your own initiative and are responsible for compliance with local laws.

3. Pricing and Availability

The prices of goods are those specified in the In Car Magic on-line store. The prices, as displayed, are inclusive of VAT (at the current standard UK rate). There will be an additional charge for delivery – please see separate section. Orders are subject to availability. Price and availability information is subject to change without notice. In Car Magic will always endeavour to contact the customer should any product become unavailable and agree an adjustment to the customer’s order. If this is not possible, the order and total cost will be adjusted to disallow the unavailable product and dispatched; and the contract will then be deemed to have been fulfilled. In Car Magic is entitled to deliver in part.

4. Loss or Damage in Transit

The responsibility of In Car Magic for loss of or damage to goods in transit will be limited to – at the customer’s choice - replacing the products so lost or damaged or providing a refund no greater than the amount paid for those goods.

5. Return of Goods - 100% Money Back Guarantee.

All goods purchased from In Car Magic may be returned for refund, exchange or replacement within 7 working days from receipt of delivery provided they are returned in an unused and resaleable condition. We recommend that you use a return courier service, which requires a signature on receipt. All costs incurred in returning the product to In Car Magic are the customer’s responsibility. Before returning goods, please contact us by telephone for a returns reference. You will need to include this with your return parcel so that we may tie the transactions together. Failure to do so may result in delay of any refund. You will be asked the reason for the return, whether you prefer a refund or exchange and to confirm the item has not been used or damaged. In addition, you will need to provide your name, original order number and postcode, so please have these available.

6. Intellectual Property

All the information, data, text, graphics, links or computer code published on, contained or available on this website (hereinafter referred to as the ‘Material’) are the copyright of In Car Magic. Unauthorised use of the Material including the production, storage, modification, distribution or republication without the prior written consent of In Car Magic or where applicable, the respective copyright owner(s) is prohibited. The names and logos of In Car Magic and all related products and service names, design marks and slogans are the trade names, service marks or trade marks of In Car Magic and may not be used without the prior written consent of In Car Magic.

7. Disclaimer

In Car Magic makes no warranty in respect of any products or service advertised on this website which is supplied by a supplier independent of In Car Magic. In Car Magic hereby, to the fullest extent permitted by law, disclaims all warranties and conditions with regard to the material and any goods and services supplied in relation to this website, whether expressed or implied or statutory (including all implied warranties and conditions of the merchant ability and fitness for a particular purpose). In no event that In Car Magic be liable for any indirect, punitive, special, incidental or consequential damages whatsoever even if In Car Magic has been advised of the possibility of damages including, without limitation, damages for loss of use, data or profits arising out of or in any way connected with the use or performance of this website, interruptions or delays to this website, the provision of or failing to provide services, or for any information, material, goods and services obtain through this website or otherwise arising out of the use of this website, whether based on contract, tort or otherwise to the fullest extent permitted by law.

8. Invalidity of Terms and Conditions

If for any reason part of these terms and conditions is deemed unenforceable, the validity of the remaining terms and conditions will not be affected.
